Terms and Conditions.
1. Introduction
These general terms and conditions apply to package tour contracts (as defined in article L. 225-2 of the Luxembourg Consumer Code) organized by Mulligan Greens and reserved from 15 December 2025.
Definitions:
• Organiser: Mulligan Greens, S.A.R.L. Société Anonyme, Luxembourg Trade and Companies Register XXX.
• Traveller/Customer: The natural person concluding or intending to conclude a Mulligan Greens tours package travel contract.
• Retailer/Travel Agency: The travel agent through whom the Traveller concludes the contract.
2. Precontractual Information
2.1 Information Provided: Prior to concluding a travel contract, the Organiser and the retailer provide the Traveller with the legally stipulated standard information as well as the following:
1. Contact details of the Organiser and retailer, if applicable
2. Main features of the travel services:
o Destinations, itinerary, and holiday periods: Including dates and number of nights. For example, a 7-night stay in India from 22nd February to 1st March2025
o Transport details: Means, features, and categories of transport, locations, dates, and times of departure and return, duration, and location of stopovers and connections. For example, a flight from Luxembourg to Delhi with a 2-hour layover in Frankfurt includingtravel class. Local tentative itinerary in India will be shared separately 7 days before arrival
o Accommodation details: Location, main features, and tourist category of accommodation. For example, a 5-star hotel in Jaipur with breakfast included.
o Meals provided: For example, half-board including breakfast and dinner.
o Visits and excursions: Included in the total agreed package price. For example, a guided tour of the Taj Mahal.
o Group travel details: Whether the services will be provided to the Traveller as a member of a group and the approximate size of this group. For example, a group of 20 people.
o Language of services: Effective verbal communication and the language in which these services will be provided. For example, English-speaking tour guide.
o Suitability for persons with reduced mobility: Information on whether the trip or holiday is generally suitable for persons with reduced mobility and specific individual requirements.
o Golf Handicap requirements
3. Total price of the package tour and additional fees.
4. Terms of payment, including deposit and balance payment schedule.
5. Minimum number of participants required and cancellation deadlines.
6. Passport, visa, and health formalities.
7. Traveller's right to cancel and standard cancellation costs.
8. Information on cancellation insurance and travel assistance insurance.
2.2 Delivery: Precontractual information is delivered via these general terms and conditions, the travel agency, or the website.
2.3 Modification: Precontractual information forms part of the contract and may not be changed unless the Traveller is informed and accepts the modifications.
3. Contract
3.1 Engagement: The Traveller agrees to:
• Provide all relevant information influencing the contract content.
• Ensure all personal data is correctly completed.
• Guarantee the proper performance of contractual obligations for all individuals included in the contract.
3.2 Delivery: The Organiser or retailer provides a copy or confirmation of the contract on a durable medium.
3.3 Information: The contract includes precontractual information and additional details such as:
1. Traveller's special requirements accepted by the Organiser.
2. Organiser's responsibilities and assistance obligations.
3. Contact details of the entity entrusted with protection against insolvency.
4. Correction of Traveller's Identity
4.1 Validity: Corrections to the Traveller's name can be requested within 24 hours of booking.
4.2 Cost: Administrative cost for correction is EUR 100.00, plus any additional costs charged by partners.
5. Travel Documents
5.1 Delivery: Travel documents are provided two weeks before departure.
5.2 Validity: Travel documents and tickets are only valid on the dates indicated.
6. Termination of the Package Travel Contract by the Traveller
6.1 Costs:
• Free cancellation more than 45 days prior to departure.
• Standard cancellation fees apply for cancellations within 30 days of departure:
o 50% of the package tour price between the 30th and 22nd day prior to departure.
o 100% of the package tour price less than 22 days prior to departure.
6.2 Additional Fees: Percentages include administrative costs not recoverable through optional cancellation insurance.
6.3 Lack of Payment: Non-payment constitutes cancellation, and standard termination costs apply.
6.4 Exceptional Circumstances: Full reimbursement if exceptional circumstances affect the package or transport. Exceptional circumstances allowing the cancellation are :
a) Natural Disasters: Events like earthquakes, hurricanes, floods, or volcanic eruptions that make travel to the destination unsafe or impossible.
b) Pandemics and Epidemics: Outbreaks of diseases such as COVID-19 that lead to travel restrictions, quarantine requirements, or health risks at the destination.
c) Political Instability: Situations like war, civil unrest, or significant political upheaval that pose safety risks to travelers.
d) Transport Strikes: Strikes by airline, railway, or other transport workers that prevent travelers from reaching their destination
7. Price
7.1 Additional Costs: Total package price excludes certain taxes, fees, and additional costs, such as:
• Parking costs at the airport.
• Travel assistance insurance.
• Cancellation insurance.
• Advanced seat reservation.
• Alcoholic drinks, tips, luggage handler services, Wi-Fi, safe at the hotel, excursions not in the plan, personal expenses.
• Tourist tax or other various taxes collected locally.
• Costs for obtaining visas upon arrival at certain destinations.
8. Revision
8.1 Price Revision: Prices may be revised due to variations in transport costs, taxes, or exchange rates.
8.2 Major Price Increases: Traveller can cancel the contract free of charge if price increases exceed 8%.
8.3 Validity: Prices cannot be increased within 20 days of departure.
9. Price Payment
9.1 Method of Payment and Deposit:
• Immediate full payment or deferred payment with a 50% deposit.
9.2 Final Payment: Final payment due 31 days before departure.
9.3 Delayed Payment: Payment default leads to contract cancellation and related fees.
10. Minimum Participants
Contract specifies the minimum number of participants and cancellation deadlines if the minimum is not met.
11. Modification of the Package Travel Contract by the Organiser
11.1 Minor Modifications: Organiser reserves the right to make minor modifications.
11.2 Significant Modifications: Traveller is informed of significant modifications and can terminate the contract without fees.
11.3 Reimbursement: Full reimbursement if the Travellerterminates the contract due to significant modifications.
12. Termination by the Organiser
Organiser may terminate the contract if the minimum number of participants is not met or due to exceptional circumstances.
13. Responsibility of the Organiser
Organiser is liable for the performance of travel services included in the contract.
16. Price Reduction and Compensation
16.1 Compensation: Traveller is entitled to a reasonable compensation for losses due to non-compliance of services.
16.2 Limitation: Compensation is limited to the maximum amount paid by the Traveller and only limited to direct damages suffered by the Traveller.
17. Insurance
Package tours do not include travel assistance or cancellation insurance. It is up to the Traveller to arrange the best insurance as per their requirements.
19. Visas, Passports, and Health Formalities
Travellers are responsible for obtaining necessary travel documents and complying with health formalities.
20. Minors
Minors must be accompanied by a responsible adult, and necessary authorizations must be provided at the time of the booking. Minors are considered as legal age <18 years at the date of (departure / booking) of the tour.
21. Marketing
Information and prices on the website and marketing materials are subject to change.
22. Flights
Travellers must check flight details and comply with airline policies.Organizer offers the business class ticket as part of the tour package. Organizers guarantees reservation in reputed scheduled airlines however, doesn’t guarantee reservation in the preferred airline of the traveller.
23. Golf Arrangements
23.1 Booking and Confirmation:
• The golf included with each holiday may be changed to other courses with a similar quality due to non-availability of the requested course, and the difference in price will be charged or refunded. Once we have received confirmation of your times from the golf clubs, we will notify you in writing.
23.2 Amendments and Cancellations:
• Once your golf times have been confirmed by the golf clubs, we reserve the right to charge an amendment fee if the Traveller decide to change or cancel the time schedule, the course booked or the golf itself.
23.3 Vouchers:
• Vouchers will be issued for green fees paid by us. These will be dispatched with travel documents or provided in the resort and should be presented at the golf club a minimum of 20 minutes prior to play commencing.
• Unused vouchers will not be refunded unless course closure has prevented play. In such cases, written confirmation from the club concerned or our local representative is required before a refund can be made. This also applies to tee-times booked for the arrival day if unable to play due to delays, etc.
23.4 Local Fees:
• Local golf taxes, golf insurance, and federation fees, if applicable, are payable by you directly to the golf club.
23.5 Handicap Certificates:
• Some golf courses require a valid handicap certificate. It is your responsibility to ensure that a valid certificate is available for presentation locally if required and that your handicap meets the requirements of the particular courses you wish to play.
23.6 Start Times:
• Though atmost care is taken to follow the confirmed schedule, we reserve the right to vary both the start times and courses after they have been confirmed. Golf course management reserves the right to change tee-times at their discretion without prior notification. You will be duly notified for changes if any.
24. Miscellaneous:
24.1 GDPR
The Organiser agrees that during the execution of this Contract he is obliged to comply and respect the principles of legality, consent, information, quality, purpose, proportionality and any other indicated by Regulation (EU) 2016/679 of the EuropeanParliament and of the Council of 27 April 2016 on the protection of natural persons (the “GDPR”).
By using our services, the Traveller agree to the collection, use, and sharing of your personal data as described in the GDPR and the Organizer commits to use the personal data strictly forthe purpose of the service rendered under the present Terms and Conditions.
The Traveller has the right to ask for modification, correction and deletion of his the personal data provided at any time and after the services have been rendered by communication in writing his request to XXX@XXX.com
24.2 Applicable law and jurisdiction:
The present contract is governed by the laws of Luxembourg.
If a disagreement appears between the Parties regarding the performance of this Agreement, the matter shall be negotiated in good faith between the Parties within a maximum period of two (2) months from the date of the notification delivered by any Party declaring that a disagreement exists. If a solution is not reached within the above mentioned two month’s period of negotiation, the Parties may submit their dispute to the Courts of Luxembourg.
24.3 Statute of limitations: The Parties agree that any dispute arising from the services rendered must be resolved within six months from the date of service completion. Any claims brought before the Luxembourg Courts after this period will be deemed time-barred and will not be considered.
24.4 Separability: if any provision of this Contract is held by any courtor any other competent authority to interpret it be invalid or unenforceable in whole or in part, the Contract continues to be valid as to its other provisions and the remainder of the affected provision.
